EMPLOYMENT DISCRIMINATION CLAIMS

The Age Discrimination in Employment Act of 1967 (ADEA) protects workers forty and over from being fired or denied jobs or promotions because of age. There is no upper age limit to the ADEA. Ranking right behind age discrimination in numbers of cases filed are sex discrimination (denial of employment opportunities or benefits based upon gender) and sexual harassment complaints (misconduct, based on sex).

Moving quickly up the ladder on the most active list of job-related abuses are complaints of disability discrimination. Prohibited by various states for many years, and for federal contractors (by the Rehabilitation Act of 1973), discrimination based on disability became unlawful nationwide with the passage of the Americans with Disabilities Act of 1991 (ADA).

Employment discrimination laws seek to prevent discrimination by employers based on race, gender, religion, national origin, physical disability, or age.
